吉田寮に注目する全ての市民の皆さん

はじめに

私たち「吉田寮とつながる会」は、吉田寮の元寮生を中心として、吉田寮へ心を寄せる市民たちにより、2018年10月に結成されました。以降、吉田寮に関する事態を注視し、その推移を見守ってきました。

一昨年12月19日に突如、期限を切った吉田寮からの学生の退去を命ずる、京都大学の決定が発表されました。以降、吉田寮自治会との話し合い中の恫喝、話し合いの一方的な打ち切り、裁判手続き、そして2月12日の役員会コメントの発表と、わずか1年余りの間に、事態が急速に展開しています。私たちは、今般の京都大学役員会の吉田寮に対する一連の行動は、以下にあげる点から看過できないものと考え、下記のとおり意見を述べます。

意見の趣旨

• 私たちは、京都大学役員会の横暴な態度を残念に思い、105年の自治の歴史を刻んできた吉田寮が今こそその自治の価値をかけて高圧的な京都大学役員会と交渉しようとしていることを支持します。

• 私たちは、自由の学府であり豊かな学内自治を実践してきた京都大学の伝統が、京都大学役員会によって蹂躙されていることに失望し、ただちに本来の職務である京都大学の特性を生かした、自由と責任を自ら任じ、より良き世界の実現のための研究・教育環境の整備を果たすことを求めます。

• 私たちは、京都大学役員会が「法制度的権限」に基づくと主張する狭量で不当な決定とその実施を、憂慮し危惧します。

• 私たちは、吉田寮に注目する全ての市民の皆さんに、京都大学役員会が行っている民主主義的手続きの破壊に注目し、抗議していただきますよう要請します。

• 私たちは、吉田寮に注目する全ての市民の皆さんに、京都大学役員会の独断的な行為により様々な障害を受けながらも、豊かな創造性と人間性をもって対話を求め続け、より良き学生生活を実現しようと努めている吉田寮自治会の学生諸君への支持を要請します。

意見の理由

１．京都大学役員会による暴走

  京都大学の「自由」とは、わずか8名から構成される役員会が「組織運営の決まり」に基づいて暴走してもよい「自由」でしょうか。決してそうではありません。実際に正統性が疑われる「決定」がなされました。当局の吉田寮に対する営為に対しては尾池和夫元総長や学内の教員からも驚きと、対話を促す声が上がっています。一般に、「組織運営の決まり」に基づく「合法的」な決定が、はたして正しい方向を促すかどうか、日ごろから構成員が吟味し、必要であれば修正を求めることは、民主主義的手続きの根幹をなします。正統性が疑われる「決定」については、構成員がその内容について異議申し立てや対話を求めても差し支えないと考えます。そして、京都大学の「基本理念」には「対話を根幹とする自学自習」とあります。暴走を止めて対話すべきと考えます。一方的に決めた通達に従わないことを理由に、相手との対話を認めない態度は、高圧的で傲慢といえます。そして、その圧力の前に思慮深く対話を求め、意見の異なるものとの共存を模索する吉田寮自治会のまっとうさを、心ある人々は感じています。

２．京都大学の話し合いの伝統の破壊

  京都大学役員会のコメントでは、話し合いの相手を一方的に制限し指定し、役員会決定の受け入れを話し合いの条件としており、その横暴さに、私たちは言葉を失います。「対話を根幹」「教育研究組織の自治を尊重」「人権を尊重」と謳う京都大学の「基本理念」から著しく逸脱しているからです。役員会活動の根幹は「基本理念」であるにも関わらずです。僅か8名で構成される役員会が、京都大学の話し合いで物事を決め進めてゆく伝統、多くの困難と葛藤を経て培ってきた大学自治の伝統を、簒奪し破壊する資格も、権限もないと、かつて京都大学に学び、あるいは現在も大学の活動を注視している私たちは強く主張します。「基本理念」を軽視し、このような不当な決定がなされ実行に移されているとき、私たちは、京都大学の自治の伝統、すなわち意見の異なるものも仲間として認め、相互の粘り強い対話の努力により合意を導き出す伝統の意義を再確認し、これを守らなければならないと考えます。

３．社会的経済的弱者への配慮の欠如

大学はそこで学ぶ学生を守らなければなりません。困難な状況に置かれている学生がいれば、大学はそれを慮るものでなければなりません。しかし京都大学役員会は、これと逆行しその様な学生生活を切り捨てる方向に進んでいます。

  経済的な困難を抱えてなお、勉学と研究に勤しむ学生への敬意を欠いた圧迫は、彼らを困難な状況に追い詰めます。未来の世界に貢献すべくそれぞれのやり方で努力している若者を、大切でかけがえのない存在として応援し見守ることこそ、人生の先輩である役員会の役割であると考えます。

まとめ

私たちは、京都大学役員会が、一方的な決定の押しつけ、決定内容の過激化を反省し、撤回すること、そして吉田寮自治会と真摯に敬意をもって話し合いを再開、継続することを求め、ここに以上の意見を表明します。

To all the people who care about Yoshida Dormitory

Introduction

  "Yoshida Dormitory Support Group" was established by past residents of Yoshida Dormitory (Yoshida-ryo) and sympathizing citizens in October, 2018, and has ever since carefully watched the situations and the turn regarding the Yoshida Dormitory issue.  

  Kyoto University announced on 19 December 2017 that the current occupants of Yoshida Dormitory must move out by the end of September 2018.  The situation has developed rapidly over the course of just one year since then: The members of the dormitory student councils (ryo-jichikai) faced coercion during discussions with the university officials, and further talks were decisively refused.  Legal proceedings followed, and on February 12 this year, the executive board of the university announced a new statement.  We believe that the series of actions taken by the university toward the residents of Yoshida Dormitory are not acceptable for the following reasons and hereby express our views as follows.

Points of Our Views

• We are dismayed by the tyrannical approach of the board of Kyoto University. We support the residents at Yoshida Dormitory, who are trying their best to negotiate with the intimidating authorities, to protect the self-governing history of 105 years and the values of independence at a crisis.

• We are disappointed that the traditions of Kyoto University as a liberal educational institution that has kept the practice of rich campus autonomy are trampled on by the executives. We demand that the university fulfill their primary function of maintaining the research and education environment meant for building a better world, drawing on its unique characteristics of self-imposed freedom and responsibilities.

• We are worried and disturbed by the university's intolerant and unfair decisions for Yoshida Dormitory and execution of actions that they claim are based on their "legal rights".

• We call for citizens to give attention to the destruction of democratic practices by the board of the university and protest against it.

• We ask you all to support the students of the dormitory student councils, who endeavor to lead better student lives with abundant creativity and humanity and keep seeking a dialogue, undeterred by the difficulties imposed by the autocratic behaviors of the university.

Reasons for Our Views

1. Despotic management by the board of Kyoto University

  Does "academic freedom" proclaimed in the University’s Mission Statement mean to allow the only 8 members of the board of the University to do as free as they may please, on the basis of the "organization management rules"?  Absolutely not.  In actuality, however, they made an unjustifiable "decision".  With regard to the despotic conduct of the board in dealing with the Yoshida Dormitory, the former President Kazuo Oike, as well as some of the faculty on the campus, have expressed their shocks and are urging them to have more talks with the students.  Generally speaking, whenever a "legitimate" decision is made based on "organization management rules", it is the bedrock of democratic processes for the members of the organization to assess the righteousness of that decision and demand an amendment if necessary.  If the "decision" is deemed debatable by some, they are entitled to raise an objection to, or request a dialogue about the content of the decision.  As Kyoto University’s Mission Statement goes, it is supposed to promote “independent and interactive learning”. The member of the board should stop being autocratic and start interactive talks with students. It is a coercive and arrogant behavior to refuse communication because people do not obey the imposed notice. The dormitory student councils are calling for a dialogue and trying to find a way to coexistence with conflicting views in the face of such pressure, and it is this thoughtful and decent conduct of the committee that is making people feel compassion.

2. Destruction of the university's tradition of dialogue

We are appalled at the overbearing comments of the board. Our disappointment is beyond word. In the statement on 14 February, the board announce that they accept the talks with the students only if they obey under the decision made by the board. This is far from the supposed policies of "independent and interactive learning", "administrative independence of educational and research institutions", and "respect for human rights" as declared in the Mission Statement.  Needless to say, the Mission Statement is the very foundation of the administrative activities of the executives.  The board consists only of 8 members.  They are neither qualified nor entitled to usurp and destroy the tradition of dialogue-based decision making, the tradition of autonomy that Kyoto University has fostered over the years through so many struggles and conflicts.  For some of us who once studied at Kyoto University, or have been alerted to the recent actions of the university, this cannot be stressed more.  Now, faced with the "Mission Statement" being made light of and such an unjust decision being made and going to be executed, we must be reminded of the significance of, and protect, the tradition of self-governance at Kyoto University, the tradition of accepting others with different views as fellow members and making mutual strenuous efforts to reach an agreement through discussion.

3. Lack of consideration for socially and economically challenged

  Universities have the duty to protect their students.  If there are any students in financial difficulty, the administrators must give them consideration.  The executives at Kyoto University are doing the opposite, depriving such students of the opportunity to live near the campus cheaper.

  The contemptuous, oppressive attitude to the needy students struggling to thrive in their studies and research will only drive them into further difficulties.  We believe it is the very role of the university board, as mature members of the community, to regard young people who are striving, each on their own way, with a view to contribute to the world in future, as valuable assets and support them.

Conclusion

  We have hereby expressed our views as above, hoping that the board of executives of Kyoto University reflect on how single-mindedly they forced their decision and how harsh its content is, and take it back, and that they resume and continue respectful talks with the dormitory student councils.

致关注吉田寮问题的居民朋友们的一封信

——所谓大学者，非有大官之谓也，有大师之谓也

绪言

吉田寮连携会是由吉田寮毕业生与关心吉田寮的居民朋友们于2018年10月共同发起的团体。我们一直密切关注着有关吉田寮的各种事态进展。

前年12月19日，京都大学当局突然下令，全体学生在规定期限内离开吉田寮。此后，大学负责人在与吉田寮自治会的会谈中高声呵斥学生，单方面取消会谈，开始诉讼程序，发布2月12日校务会声明，1年多的时间里，有关吉田寮的事态不断扩大。我们认为，京都大学校务会对吉田寮采取的种种举措，作为大学是非常不适当的，以下是我们的看法。

吉田寮连携会的看法

• 我们为京都大学校务会蛮横的态度感到遗憾。我们支持拥有105年自治历史的吉田寮不畏强暴，继续进行与京都大学校务会进行对话的努力。

• 我们对目前京都大学校务会，无视学校光荣传统和先辈们的努力，肆意破坏自由・自主的大学精神的行为感到失望。我们希望，京都大学校务会履行应有的职责，保护和发扬京大传统，为师生营造好教学科研环境，不要肆意制造事端，干扰学校秩序。

• 我们对京都大学校务会滥用法规赋予的所谓权限，肆意破坏大学传统的种种行为感到震惊和忧虑。

• 我们欢迎所有关注吉田寮的人士，与我们一道，反对京都大学校务会的肆意妄为，直接向京都大学提出意见。

• 我们欢迎所有关注吉田寮的人士支持我们那些在京都大学校务会的种种蛮横行径下，仍然发挥创造性，努力充实自己，过好学生生活的学生娃们。

吉田寮连携会的认识

１．京都大学校务会的独断专行

  京都大学的所谓“自由”，就是校务会的8个校领导，想干什么就干什么的自由吗？绝对不是这样，大学该自由的是师生，不是校领导。现任校领导的种种行为是否合法合规？对于校务会采取的种种举措，尾池和夫老校长以及京大教员都表示震惊，要求校务会重新开始与学生对话。京都大学作为学校做出的决定，从来都是

经过征询师生意见后进行的，不是几个校领导随意做的。京都大学的“基本理念”中说，“注重对话的自学自习”。京大要培养的是自由・自主的人才，不是听话的奴才。目前校领导的所作所为是与京大的理念・传统背道而驰的。京大的校领导以不遵守校领导决定为理由，不承认进行对话的必要性，另一方面，吉田寮的学生们在高压面前始终主张对话，努力摸索不同主张共存的方式，谁的主张符合京大的理念・传统，谁的主张合法合规，是很明显的。

２．破坏京都大学协商的传统

  京都大学校务会在声明中，单方面规定协商的参与者，并且把接受校领导决定作为进行协商的前提。我们对这种粗暴的态度感到愤怒。校领导的所作所为完全违背了“对话是根本”“尊重教学科研组织的自治”“尊重人权”的京都大学“基本理念”。根据京都大学的规定，校务会工作必须遵循京都大学“基本理念”，8名现任校领导有什么权力，践踏京都大学的“基本理念”，破坏大学自治的传统？曾经在京都大学学习的我们，坚决主张，京都大学是大师的学堂，不是大官的官场！

３．缺乏对社会经济中弱者的关爱

  大学必须保护学生。如果有经济面临困难的学生，大学应该想办法进行照顾。但是，京都大学校务会在做着完全相反的事情。

  如果没有对经济困难学生的尊重和关爱，这些学生很明显会陷入困境。想方设法关爱这些承担起未来的人才，是作为成年人的校领导的应尽之责。

结语

  我们要求，京都大学校务会反思单方面强行做出规定，扰乱学校正常秩序的行为，与吉田寮的学生重新开始真诚并且相互尊重的对话。

  我们希望，京都大学越办越好，多出大师，少出大官。

Pour tous ceux qui veulent que Yoshida-ryo continue à exister

Nous, Yoshida-ryo to tsunagaru-kai « ceux qui tiennent Yoshida-ryo », sommes réunis autour d’anciens résidents de Yoshida-ryo(désormais Ryo), en octobre 2018. Depuis, nous regardons attentivement la situation et comment les choses vont aller.

Le 19 décembre 2017, très brusquement, l’Université de Kyoto a annoncé sa décision de faire quitter tous les résidants de Ryo. Suivant cela, brutalement, la situation s’aggrave ; intimidation de la part de vice-président (de recteur) pendant la discussion avec le comité de Ryo, annulation unilatérale de la discussion, procédure judiciaire, et le commentaire du comité de direction annoncé au 12 février 2019. Considérant comme inadmissible, pour les raisons données ci-dessous, l’attitude du comité de direction de l’Université de ces dernier-temps, nous déclarons comme suit ;

Notre avis :

• Nous regrettons la tyrannie du comité de direction de l’Université de Kyoto. Nous soutenons Yoshida-ryo, qui a 105 ans de l’histoire d’autonomie, et qui maintenant essaie de discuter avec la direction, qui se comporte d’une façon dictatoriale.
• Nous sommes déçus par le fait que la tradition de l’Université de Kyoto, celle de la liberté et de la riche autonomie, est en train d’être détruite par la comité de direction actuel. Nous demandons à celui-ci de retourner, au nom de la liberté et de la responsabilité de l’Université de Kyoto, à sa fonction originelle, d’amélioration de l’environnement d’éducation et de recherche pour rendre le monde meilleur.
• Nous redoutons la décision étroite et injuste prise par le comité de direction de l’Université, que celui-ci prétend fondée sur l’autorité judiciaire. Nous craignons que cette mauvaise décision ne soit appliquée.
• Nous demandons à tous les citoyens d’être attentifs à la manière dont le comité de direction de l’Université détruit le processus démocratique, et de protester contre cette violence.
• Nous soutenons et demandons à tous les citoyens de soutenir les étudiants de Yoshida-ryo, qui, malgré des ennuis causés par les comportements dogmatiques du comité de la direction de Kyodai, veulent toujours le dialogue et qui essaient de réaliser une meilleure vie étudiante avec la créativité et l’humanité.

Nous déclarons parce que …

1. Parce que le comité de la direction de l’Université fait table rase des acquis.

La « liberté » de l’Université de Kyoto, est-ce une « liberté » qui permet au comité de la direction, constitué seulement de 8 personnes, de faire table rase des traditions de Kyodai au nom de « la gestion de l’organisation » ? Non, jamais. La « décision » de la direction universitaire remet en cause sa légitimité. Contre le comportement des autorités de l’Université, s’élèvent des voix, marquées par un fort étonnement, et qui invitent au dialogue, de la part de Mr. Oike, l’ancien président l’université de Kyoto, et de la part des enseignants de l’université. En générale, les membres d’une organisation peuvent interroger si une décision « légale », prétendument fondée sur « la gestion de l’organisation », va dans la bonne direction ou pas, et si nécessaire, demander de la corriger. C’est la base de démocratie. Et si la légitimité d’une « décision » est remise en cause, il est normal qu’un membre puisse y faire objection. Et s’il voulait discuter, c’est tout à fait normal. On trouve dans la « philosophie de base » de l’université de Kyoto, « Auto-apprentissage et auto-étude fondés sur le dialogue ». Il faut arrêter de vouloir tout changer, et se remettre à dialoguer. Il est arrogant et orgueilleux de refuser le dialogue pour la raison que l’autre n’obéit pas à un ordre donné d’une façon unilatérale. Et les étudiants de Yoshida-ryo ont raison de vouloir dialoguer et de chercher à coexister avec un autrui qui a un avis différent, bien qu’ils soient confrontés à la pression énorme de l’autorité. 

2. Parce que la tradition du dialogue à l’Université de Kyoto est en train d’être dédruite.

L’attitude dominatrice du comité de la direction nous choque profondement ; celui-ci limite et fixe unilatéralement ceux qui peuvent venir à la table de discussion, et pose l’obéissance à sa décision comme condition pour recommencer à dialoguer. Cela s’écarte totalement de la « philosophie de base » de l’université de Kyoto, qui se « fonde sur le dialogue », qui « respecte l’autonomie des organisations d’éducation et de recherche » et qui « respecte le droit d’homme », bien que le comité de direction se réclame de la « philosophie de base ».  Nous, qui avons étudié jadis à l’université de Kyoto, et qui regardons attentivement où va l’université, affirmons que le comité de direction, constitué seulement huit personnes, n’a aucun droit de détruire la tradition de dialogue, la tradition d’autonomie d’université, cultivée à travers beaucop de difficultés et conflits. Quand la « philosophie de base » est dépréciée, et quand une décision injuste est en train de se réaliser, nous devons confirmer et garder les valeurs de notre tradition d’autonomie, admettre les différences d’avis, et parvenir enfin à un accord à travers longues et tenaces discussions. 

3 Le manque de respect pour les étudiants socialement et économiquement faibles

Une université doit protéger ses étudiants. Elle doit penser à l’étudiant qui connait une condition difficile. Or le comité de la direction de l’Université de Kyoto va dans un sens opposé, en abandonnant des étudiants économiquement faibles. Les étudiants, qui veulent étudier, malgré leur condition économiquement difficile, se trouvent coincés à cause d’une oppression sans respect. Cela ne va pas dans la bonne direction. Il faut que le comité de Kyodai, en tant qu’adulte, joue son rôle qui est de garder et d’encourager les jeunes, qui font des efforts et qui contribueront à l’avenir du monde.

Nous déclarons notre avis ci-dessus, demandant au comité de direction de l’université de Kyoto de réfléchir et de revenir sur sa décision unilatérale et sa radicalité, et de reprendre le dialogue avec Yoshida-ryo, avec sincérité et respect.
